Kindly note that you will have to contact the cellphone store you purchased the device from so that the original owner can unlock the device.

I bought it from a used cell phone store and no he said it was already unlocked so he didn't have the code that was used. This phone is capable of working on the CDMA network correct?

If the phone was paid off it shouldn't matter who they heck owns it now it's THEIRS At&t already made the money off the phone so to try and keep a person from using the phone oversees they are claiming it has to be unlocked by the original owner and that we can't do it

You have no way of knowing the phone paid off. For all you know the original purchaser walked away from the phone payments and the account payments which means AT&T doesn't have to unlock it.
And since you are not AT&T's customer and the not the original purchaser of the phone, AT&T doesn't owe you any customer support.
If you use the link I provided and the phone unlock is denied, it should say why. If it says the phone isn't paid off, then you're stuck and you should return the phone
