Received a Refurbished phone on a new AT&T account

Why on earth would I be getting a refurbished phone on my new AT&T plan. The other 3 phones on the plan are brand new. How can I get this fixed? Seems rather fishy to me. Can we say "Lemon Law".

Please let us know:

If you received a replacement device with Asurion, this may be the reason why you received the refurbished device.
If you purchased the device online, customers can purchase Certified Pre-Owned devices on att.com at the no-commitment pricing option or on installment.
If you purchased the device online as refurbished. So we can better assist you.

What makes you think it was refurbished? Lemon law refers to something entirely different than what you're talking about.

Yeah, we can say "lemon law" all day long, but that does not apply here.
